Understanding your Phase I findings

The finding is the beginning of a decision, not a substitute for one. Read the condition, the evidence, the limitations, and the environmental professional’s reasoning together before deciding how to proceed.

What does REC mean?

A recognized environmental condition (REC) concerns hazardous substances or petroleum associated with a release, likely release, or a material threat of a future release. It is an ASTM assessment classification, not a laboratory result. Ask which facts support the finding and what additional information would help resolve the uncertainty.

How is an HREC different?

A historical recognized environmental condition (HREC) describes a past release addressed to the satisfaction of the applicable regulator, meeting unrestricted-use criteria without required controls. A closure letter should be evaluated with current criteria and conditions before assuming the historical classification still applies.

What is a CREC?

A controlled recognized environmental condition (CREC) is a REC associated with a past release addressed to regulatory satisfaction while contamination remains subject to required controls. Understand the restrictions, responsible parties, maintenance, and documentation before acquiring or changing use.

What makes a data gap significant?

Missing information is evaluated for its effect on the environmental professional’s ability to identify RECs. An unavailable historical source or inaccessible area is not automatically significant. The report should explain the missing information, efforts to obtain it, and why the limitation does or does not affect the assessment’s conclusions.

What is a business environmental risk?

A business environmental risk (BER) can affect a business or transaction without meeting the definition of a REC. Building materials, compliance issues, or redevelopment constraints may merit separate consideration depending on the agreed scope. A BER label does not mean the issue is unimportant, and it should not replace a supported REC determination.

Does regulatory closure settle every issue?

Review what was closed: the affected media, contaminants, property boundaries, land use, and exposure pathways. A letter for a tank release may not address every former operation or a later redevelopment scenario. Obtain the underlying investigation and closure conditions when they are relevant to the transaction.
